By accessing or using JPK Glass Requests ("JPK Glass Requests" or "the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is operated by Kilbourne.JP, LLC d/b/a JPK Collision Solutions ("Company," "we," "us," or "our").
JPK Glass Requests is a cloud-based tool designed for collision repair businesses to: create structured glass pull/replace/reinstall requests, transmit those requests by email to a glass vendor of the shop's choosing, track per-piece status on a shared board, record vendor acknowledgment of requests, and store related details such as quote numbers and timing.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials, all activities that occur under your account, and notifying us immediately of any unauthorized use.
JPK Glass Requests is offered on a monthly subscription at a current rate of $34.00 per month, following a 30-day free trial. A valid payment method is required to begin the free trial. You will not be charged during the free trial; unless you cancel before the trial ends, your subscription will begin and your payment method will be charged the then-current rate.
AUTOMATIC RENEWAL NOTICE: YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW EACH MONTH UNLESS YOU CANCEL. You will be charged the then-current renewal price using the payment method on file.
How to Cancel: You may cancel your subscription at any time by: (a) logging into your account and using the "Manage billing" option to open the customer billing portal and selecting cancel, or (b) emailing jpk@jpkauto.com with the subject "Cancel Subscription." Cancellations take effect at the end of the then-current billing period; you retain access through the period you have paid for.
You agree to use JPK Glass Requests only for its intended purpose of coordinating glass requests in connection with legitimate collision repair work, in compliance with all applicable laws. You may not use the Service to: send unsolicited or unlawful communications to vendors or others; attempt to gain unauthorized access to other customers' data or systems; reverse engineer, decompile, or attempt to derive the source code of the Service; or resell, sublicense, or transfer access to the Service to third parties.
You retain ownership of all data you input into the Service. You grant us a license to use your data solely to provide the Service. Upon termination, you may request export of your data within 60 days. We may retain anonymized/aggregated data for analytics or metrics.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
IN NO EVENT SHALL KILBOURNE.JP, LLC D/B/A JPK COLLISION SOLUTIONS BE LIABLE FOR: Any indirect, incidental, special, or consequential damages; loss of profits, data, or business opportunities; damages exceeding the amount paid for the Service in the 12 months prior to the claim.
YOU ACKNOWLEDGE THAT: the Service is a coordination tool and does not guarantee vendor performance, delivery of correct glass, or timeliness; you remain responsible for verifying requests and orders with your vendor; technical issues may occasionally affect availability; and you are responsible for compliance with applicable laws in your jurisdiction.
You agree to indemnify and hold harmless Kilbourne.JP, LLC d/b/a JPK Collision Solutions from any claims, damages, or expenses arising from: Your use of the Service, your violation of these Terms, your violation of any third-party rights, and disputes between you and your glass vendors or customers.
We strive for high uptime but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice when possible. We are not liable for downtime due to factors beyond our control.
Kilbourne.JP, LLC d/b/a JPK Collision Solutions shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, war, terrorism, riots, civil unrest, government actions, embargoes, labor disputes, failure of third-party hosting or cloud service providers (including Google/Firebase, Stripe, or Resend), internet service interruptions, cyberattacks, power outages, or any other event that could not have been reasonably foreseen or prevented.
We reserve the right to: Modify or discontinue features with reasonable notice, update these Terms at any time. Changes become effective upon posting to our website.
You may cancel your subscription at any time. We may terminate accounts for violation of these Terms. Upon termination, your access to the Service will cease. Data retention follows our Privacy Policy (60 days for export).
These Terms shall be governed by the laws of the State of Ohio, without regard to conflict of law principles.
13.1 Informal Resolution: Before initiating any formal dispute resolution proceeding, you agree to first contact us at jpk@jpkauto.com and attempt to resolve any dispute informally through discussions with our principals or attorneys.
13.2 Binding Arbitration: Any dispute that cannot be resolved informally within 6 months of initiation shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.
13.3 Location: The arbitration shall take place in Lorain County, Ohio, or at another location mutually agreed upon.
13.4 CLASS ACTION WAIVER: YOU AND KILBOURNE.JP, LLC D/B/A JPK COLLISION SOLUTIONS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
13.5 Small Claims Exception: Either party may bring an individual action in small claims court if the claim so qualifies for such resolution.
13.6 Opt-Out Right: You have the right to opt out of binding arbitration within 30 days of first accepting these Terms by sending written notice.
